PAIA Manual
1. Introduction
This manual is published by Fintec Group (Pty) Ltd (“Fintec Group”) in terms of Section 51 of the Promotion of Access to Information Act 2 of 2000 (PAIA), to facilitate requests for access to records held by Fintec Group as a private body.

3. Guide on how to use PAIA
The South African Human Rights Commission (SAHRC) has, in terms of Section 10 of PAIA, published a guide containing information to assist a person wishing to exercise a right of access to information under the Act. That guide is available from the SAHRC:

4. Records available under other legislation
Certain records held by Fintec Group are also governed by other legislation, including the Tax Administration Act 28 of 2011, the Companies Act 71 of 2008, and the Protection of Personal Information Act 4 of 2013 (POPIA). Access to personal information under POPIA can be requested using the process described in our Privacy Policy.
5. Records held by Fintec Group
Fintec Group holds records in the following broad categories in the ordinary course of business:

Some of these records contain personal information of clients, employees of clients, or website users, and are also subject to POPIA.

7. How to request access to a record
A request for access to a record must be made in the prescribed form (Form 2, under the PAIA Regulations) to the Information Officer at the contact details in section 2, and must provide sufficient detail to enable the record to be identified, and an address or contact details in the Republic of South Africa for the response.

8. Fees
A request fee and access fees may apply, calculated in accordance with the fee schedule prescribed under the PAIA Regulations. Any applicable fees will be communicated once a request is received and assessed.
9. Grounds for refusal
Access to a record, or part of a record, may be refused on grounds permitted under PAIA — including where the record contains the personal information of a third party, privileged information, or commercially sensitive information, subject to the mandatory and discretionary grounds set out in the Act.
10. Remedies
If a request is refused, or not responded to within the timeframes prescribed by PAIA, the requester may lodge a complaint with the Information Regulator, or apply to a court for appropriate relief, as provided for under PAIA.
